Sometimes you just need some room to breathe and figure out what to do about a bad financial situation. When debt collectors are frequently calling your phone, it can feel like the walls are closing in.
Fortunately, the law provides you with several tools to make the calls, letters, and other communications stop.
The Fair Debt Collection Practices Act prohibits a debt collector from having any communication with a consumer who is represented by a lawyer. This prohibition is found in Section 1692c(a)(2) of the Act. You can read it here. Once you hire counsel, you can simply call the debt collector and provide your attorney’s name and number. The debt collector must cease all further contact with you.
This begs the question- how difficult or expensive is it to retain counsel? Some firms, like ours, are willing to consult with consumer clients at no charge whatsoever. There are many other practitioners such as bankruptcy lawyers that can be retained for as little as $50. When dealing with debt collectors, it is best that you become educated about your rights. Hiring a competent and experienced lawyer will offer you substantial benefits in dealing with your collectors.
There are other ways to stop a debt collector from calling you. Section 1692c(c) of the Act notes that a consumer can send a written request to a debt collector to demand that all further communication come to a stop, for example.
It is important to note that although a debt collector must stop communicating with a consumer in certain circumstances, the debt collector can still pursue other remedies against the consumer. The debt collector can still engage in credit reporting against the consumer, and the debt collector can still sue the consumer.
